Terms of Service
The agreement between you and SPZ Marketing LTD for macbend.com, the macbend macOS app, the 24-hour free trial and the Lifetime Licence.
1. Who we are and what these Terms cover
These Terms of Service (the “Terms”) are a legal agreement between you and SPZ Marketing LTD (“SPZ”, “we”, “us” or “our”), a company incorporated in England and Wales under company number 13567518, with registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. SPZ operates the macbend product and the macbend.com website.
These Terms govern: (a) your use of macbend.com and related pages; (b) your download, installation and use of the macbend macOS software; (c) the 24-hour free trial; and (d) any paid macbend licence purchased from us.
If you are a consumer, these Terms do not reduce any rights or remedies that applicable consumer law gives you and that cannot lawfully be excluded or restricted.
2. Acceptance, age and authority
By downloading, installing or using macbend, starting the trial, or purchasing a licence after being given a reasonable opportunity to read these Terms, you agree to them. At paid checkout, you will be asked to affirmatively accept the Terms before placing your order.
You must have legal capacity to enter into this agreement. If you are under 18, you may use macbend only with the permission and supervision of a parent or legal guardian, and a purchase must be made or authorised by a person legally capable of entering into the purchase contract. If you use macbend for an organisation, you confirm that you have authority to bind that organisation, but a consumer's mandatory rights remain unaffected where the law treats you as a consumer.
3. What macbend does
macbend is an ultra-lightweight macOS menu-bar utility that adds a visual fold-style transition when a compatible MacBook display is opened or closed. It runs in the background while enabled.
macbend is a visual utility only. It does not alter the physical hinge, display hardware, macOS authentication process, or Apple firmware. The visual effect depends on supported macOS APIs, permissions, compatible hardware and operating-system behaviour, each of which may change outside our control.
4. Screen Recording permission and on-device processing
To render its visual effect, macbend requires the macOS Screen Recording permission and uses Apple's ScreenCaptureKit or an equivalent supported Apple framework. macOS controls this permission and you may revoke it in System Settings.
Screen frames used by macbend are processed transiently and entirely on your Mac. macbend does not intentionally record, save, upload, transmit to SPZ, or send to a cloud service the screen frames used to create the effect.
The permission is therefore technically broad because macOS labels the operating-system capability as Screen Recording, even though macbend's stated use of the permission is limited to producing the local visual effect described above. Do not grant the permission if you do not agree to that local processing. Revoking the permission may prevent macbend from functioning.
5. 24-hour free trial
macbend includes a free trial lasting 24 consecutive hours from the first successful launch or activation of the trial on a MacBook. The trial is intended to let you evaluate the current version of macbend, including its compatibility and visual effect on your device, before buying.
No payment card is required merely to start the 24-hour trial, the trial does not automatically convert into a paid subscription, and you will not be charged automatically when the trial ends.
When the trial expires, paid features may stop working or macbend may prompt you to purchase a licence. We may use reasonable technical measures to prevent repeated or abusive trial resets, provided those measures are operated consistently with our Privacy Policy and applicable law.
6. Price, payment and Stripe
After the trial, you may purchase a macbend Lifetime Licence for a one-time price of USD $4.99. This is not a recurring subscription. There is no automatic renewal fee for the Lifetime Licence.
Before you place an order, checkout will show the product, purchase currency, total amount payable and any applicable taxes or charges that must be disclosed. The final total shown before you confirm payment is the amount you authorise us and our payment provider to charge.
Payments are processed by Stripe. We do not require you to provide full payment-card details directly to SPZ. Stripe may collect and process payment, billing, fraud-prevention and transaction information under Stripe's own terms and privacy notices. By choosing a Stripe-supported payment method, you authorise the payment transaction you submit at checkout.
A price change will apply only to purchases made after the new price is displayed. We will not impose a new recurring charge on an already-purchased Lifetime Licence merely because we later change the sale price.
You are responsible for ensuring that payment and contact information supplied at checkout is accurate and that you are authorised to use the selected payment method.
7. Order confirmation, licence key and electronic delivery
After successful payment, we will electronically provide the paid licence or licence key and a contract/order confirmation to the email address supplied at checkout, or make the licence available through the purchase flow and confirm it by email. Delivery is normally intended to occur immediately or within a few minutes after successful payment.
Your confirmation will identify the purchase and, where applicable, record your express request for immediate supply of the digital content and your acknowledgement of the effect on the statutory cancellation right described in section 11.
If you have paid but do not receive your licence or confirmation, check your spam/junk folder and then contact hello@macbend.com or Telegram @slurpzze. Do not buy a second licence solely because the first email is delayed unless support tells you to do so.
8. Licence grant and three-MacBook limit
Subject to these Terms and payment of the applicable one-time price, SPZ grants you a personal, limited, non-exclusive, non-sublicensable and non-transferable licence to install and use macbend on up to three MacBook computers that you own or control for your own use.
The licence is granted to one user and is not a three-person or team licence. You may not sell, rent, lease, sublicense, share or commercially redistribute your licence key. Reasonable use on replacement devices is permitted by deactivating an old activation where self-service deactivation is available, or by contacting us for a reasonable activation reset. We may refuse or limit reset requests where there is objective evidence of fraud, resale, key sharing or circumvention of the three-device limit.
macbend is licensed, not sold. SPZ and its licensors retain all rights in the software that are not expressly granted to you.
9. Restrictions and acceptable use
You must not, and must not help another person to:
- copy or redistribute macbend except for reasonable backup or installation copies permitted by these Terms;
- sell, rent, lease, sublicense, publish, share or transfer a licence key or paid copy to another person;
- circumvent the 24-hour trial, licence checks, device limits, security controls or other access controls;
- reverse engineer, decompile, disassemble, translate, modify or create derivative works from macbend, except to the extent applicable law expressly permits an act and does not permit that right to be excluded by contract;
- use macbend, the website or purchase systems to distribute malware, interfere with systems, conduct unauthorised access, commit fraud or violate applicable law; or
- remove or obscure proprietary notices contained in macbend.
Nothing in these Terms prevents lawful acts that applicable copyright law gives a lawful user a non-excludable right to perform, including where UK law makes a contractual prohibition void.
10. Meaning of “Lifetime Licence”, updates, support and compatibility
“Lifetime Licence” means that the licence you purchase does not expire merely because time passes and does not require recurring subscription payments. It does not mean that SPZ, macbend, any download server, activation service, support channel, specific macOS API or any particular Apple hardware model will exist, be maintained, supported or remain compatible forever.
The paid licence covers the macbend software version supplied with your purchase and maintenance updates that we choose to make available for that product. We may later offer a materially different major version, edition or separate product for an additional price, provided doing so does not make your existing paid licence expire solely because the new offering exists.
macbend depends on third-party technology controlled by Apple, including macOS permissions, ScreenCaptureKit and other system behaviour. A future macOS update, security change, hardware change or Apple API change may temporarily or permanently impair the visual effect or other functionality. We do not promise compatibility with every future version of macOS or every future MacBook. We may provide fixes or compatibility updates, but, subject to your statutory rights, we do not promise that any particular future compatibility issue can or will be resolved.
Current compatibility information is displayed before purchase. Please check the compatibility statement shown on the download and checkout pages and confirm that your MacBook and macOS version are listed as supported before buying.
11. UK consumer cancellation right, immediate digital supply and refunds
This section applies to consumers who have a statutory distance-contract cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or equivalent mandatory law.
For digital content supplied otherwise than on a tangible medium, the normal UK cancellation period is 14 days from the day after the contract is entered into. However, if you ask us to begin supplying the paid digital content during that 14-day period, your statutory cancellation right may end once supply begins, but only where the legal requirements for that loss of the right are satisfied.
If you want your paid macbend licence to be supplied and activated immediately after purchase, checkout must present a separate, unticked consent acknowledgement substantially in the following form:
“I expressly consent to the immediate supply and activation of macbend before the end of the 14-day cancellation period, and I acknowledge that I will lose my statutory right to cancel once supply begins.”
If you give that express consent and acknowledgement and we then begin immediate supply of the paid licence, the 14-day cancellation right for change of mind ends when supply begins. We will include evidence of that consent and acknowledgement in your durable contract confirmation. If you do not give the required consent and acknowledgement, we will not rely on the digital-content exception to remove your cancellation right and should not begin the paid digital supply before the statutory cancellation period ends unless another lawful arrangement is clearly agreed with you.
Where you still have a statutory cancellation right, you may exercise it by emailing hello@macbend.com with a clear statement that you wish to cancel, identifying the purchase email and order if available. If a refund is legally due following cancellation, we will make it without undue delay and no later than the deadline required by law, using the original payment method unless the law permits and you expressly agree otherwise.
The loss of a 14-day change-of-mind cancellation right does not remove your rights where digital content is faulty, not as described, not of satisfactory quality, not fit for a particular purpose made known to us, or otherwise fails to meet mandatory consumer-law requirements.
12. Faulty digital content and statutory remedies
If you are a UK consumer, the Consumer Rights Act 2015 gives you statutory rights in relation to paid digital content. Among other requirements, digital content supplied under a consumer contract must be of satisfactory quality, fit for any particular purpose made known in the circumstances required by law, and as described. These statutory rights cannot be excluded or restricted by these Terms where the law prohibits us from doing so.
Depending on the circumstances, statutory remedies may include repair or replacement, an appropriate price reduction, and certain remedies where defective digital content causes damage to a device or other digital content and we failed to use reasonable care and skill. The fact that macbend offers a trial, or that you agreed to immediate supply under section 11, does not remove those statutory remedies.
To report a fault or request a statutory remedy, contact hello@macbend.com and provide enough information to identify your order and reproduce the issue where reasonably possible.
13. Payment errors, refunds, disputes and chargebacks
If you believe a payment is incorrect, duplicated, unauthorised, or the purchased licence was not delivered, please contact us promptly so we can investigate and, where appropriate, refund or correct the issue. Nothing in these Terms prevents you from using any lawful rights or protections provided by your card issuer, payment provider or applicable law.
Refunds that we issue through Stripe are normally returned to the original payment method. The time for a refund to appear is controlled partly by Stripe, payment networks and your bank.
If a payment is refunded, reversed or charged back, we may suspend or deactivate the licence associated with that payment because the purchase price is no longer received, unless the reversal is later resolved in our favour or suspension would be inconsistent with your mandatory legal rights. We may provide Stripe, payment networks or your bank with relevant order, delivery, licence and support records to respond to a payment dispute.
14. Intellectual property
Except for third-party materials identified as such, macbend, the macbend website, their original software, code, user-interface elements, text, graphics, branding and other original materials are owned by or licensed to SPZ and are protected by intellectual-property laws.
These Terms grant only the limited software-use licence in section 8. No ownership of macbend or SPZ intellectual property transfers to you.
15. Apple trademarks and no affiliation
macbend is an independent product of SPZ Marketing LTD. SPZ and macbend are not affiliated with, endorsed by, sponsored by, approved by, or otherwise officially connected with Apple Inc.
References to Apple products or technologies, including Mac, MacBook, macOS, iPhone, iPhone Duo and ScreenCaptureKit, are descriptive or referential references intended to explain compatibility, technical operation or the style of the visual effect. Apple does not provide or warrant macbend.
Apple, Mac, MacBook, macOS and iPhone are trademarks of Apple Inc., registered in the U.S. and other countries and regions, as applicable. Other marks belong to their respective owners.
16. Website use and third-party services
You may use macbend.com for lawful purposes relating to learning about, downloading, purchasing and obtaining support for macbend. You must not probe, attack, overload, scrape in a manner that materially interferes with service operation, or attempt unauthorised access to the website or connected systems.
The website or purchase flow may link to services operated by third parties, including Stripe and Telegram. Those third parties control their own services and may have separate terms and privacy notices. A link does not make SPZ responsible for an independent third-party service.
17. Suspension and termination
You may stop using macbend at any time by disabling or uninstalling it. Uninstalling does not itself create a refund right where none exists under these Terms or applicable law.
We may suspend or terminate access to a licence where we reasonably determine that the licence key is stolen, fraudulently obtained, unlawfully redistributed, used to circumvent the three-device limit, or used in a material breach of these Terms. Where reasonably practicable and appropriate, we will give notice and an opportunity to remedy before permanent termination.
Termination does not affect rights, liabilities or payment/refund obligations accrued before termination. Sections that by their nature are intended to survive, including intellectual property, payment records, liability, governing law and privacy obligations, continue to the extent applicable.
18. Service statements and warranties
Nothing in this section excludes or restricts any statutory guarantee, term, right or remedy that cannot lawfully be excluded or restricted.
Subject to that rule, we do not promise that macbend will be uninterrupted, error-free, available forever, compatible with every MacBook or every present or future macOS release, or unaffected by changes made by Apple or other third parties. Any descriptions or compatibility statements we expressly provide at the time of purchase form part of the basis on which the product is supplied to the extent required by law.
19. Liability
19.1 Non-excludable liability. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) a liability or statutory consumer right or remedy that applicable law says cannot be excluded or restricted; or (d) any other liability that it would be unlawful to exclude or limit.
19.2 Consumers. If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill, subject always to applicable law. We are not responsible for business losses where you use macbend wholly or mainly for personal purposes. Nothing in this clause reduces any remedy for defective digital content that applicable consumer law requires us to provide.
19.3 Liability cap where lawful. Subject to sections 19.1 and 19.2, and only to the extent a limitation is permitted by law and is fair and enforceable in the circumstances, SPZ's aggregate liability arising out of or in connection with a particular macbend purchase or licence, for claims that may lawfully be limited, will not exceed the amount you actually paid to SPZ for that licence. This cap does not reduce a refund, repair/replacement right, price-reduction right, compensation right or other remedy where legislation requires a greater or different remedy.
19.4 Business users. If you acquire macbend wholly for business purposes and are not acting as a consumer, then, subject to section 19.1 and to the extent permitted by law, SPZ will not be liable for indirect or consequential loss, loss of profit, revenue, business opportunity, anticipated savings or goodwill. Any limitation remains subject to any statutory test of reasonableness that applies.
20. Changes to macbend and these Terms
We may improve, modify or discontinue features of macbend and may update these Terms for legal, security, operational or product reasons. The current Terms will be posted at https://macbend.com/terms with an effective date.
A material change to these Terms will apply prospectively and will not retroactively remove an accrued statutory right or convert an existing Lifetime Licence into a recurring subscription. The terms shown and accepted when you purchase govern that purchase to the extent required by law, except where a later change is required by law or you validly agree to it.
21. Governing law and courts
These Terms and any non-contractual obligations arising from them are governed by the laws of England and Wales.
If you are a consumer, the courts of England and Wales will have non-exclusive jurisdiction, and nothing in this clause deprives you of any mandatory protection or right to bring proceedings in another court that applicable consumer law gives you, including rights that may apply in the part of the United Kingdom or other country where you live.
If you are a business user, the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rule of law that applies.

23. General terms
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect, and the affected provision will apply to the maximum extent permitted by law. A delay in enforcing a right is not a waiver of it.
You may not transfer your personal licence or your rights under these Terms except where mandatory law permits otherwise. We may transfer our rights and obligations as part of a genuine corporate reorganisation, merger, financing or sale of the macbend business, provided that doing so does not reduce mandatory consumer protections.
These Terms, together with the specific product, price, compatibility, refund and other pre-contract information shown at checkout, form the agreement for your macbend purchase. Nothing in this clause excludes liability for fraud or prevents reliance on statements that applicable law treats as binding.
